The
National Association of REALTORS® has approved the following MLS of Choice
Policy which is required to be followed by all REALTOR® owned MLS’s.
“Effective
July 1, 2018, that MLSs be prohibited from requiring participation by all
offices of a real estate firm within the shareholder association(s)
jurisdiction and that MLSs be required to provide a no-cost waiver option
of MLS fees, dues and charges for licensees affiliated with an MLS Participant
who can demonstrate their subscription to another MLS. Further, that references
to MLS “jurisdiction” or “territory” be changed to “service area” to reflect
the true nature of the location and help eliminate confusion over the
jurisdiction of shareholder association(s).”
The
jurisdiction in which Northeast Florida Multiple Listing Service, Inc. (NEFMLS)
operates is the state of Florida.
NEFMLS has
never required all offices of a corporation to join NEFMLS.
NEFMLS
does require the broker of the office to belong to the NEFMLS before the
licensee can join NEFMLS.
Only the
personal listings of the individual licensee or broker may be entered into the
NEFMLS system. The broker may not put all listings in NEFMLS under their name.
The broker
and licensee are required to provide NEFMLS with a signed waiver along with
proof of a current paid membership in another MLS where the principal broker
participates in order to be exempt from payment of NEFMLS fees. This waiver can be found in the MLS systems
under Forms/Info.
NEFMLS may terminate and charge the broker and the
licensee full fees including penalties for falsification or violation of a
waiver. Please be sure to review the
